Cross-border mail order sales and fiscal cash registers – what do you need to know?

Do you ship goods abroad and wonder if you need a fiscal cash register? Check how the WSTO limit and place of taxation affect your obligations.

  • The obligation to have a Polish fiscal cash register applies exclusively to sales where the place of taxation is Poland. 

  • Exceeding the 10 000 EUR limit for WSTO means taxation in the consumer's country, which exempts you from the Polish cash register requirement. 

  • Registration in the VAT OSS system alone does not exempt you from a fiscal cash register, as the lack of this obligation is determined by the fact that the transaction is taxed in the buyer's country, not in Poland. 

  • Exports outside the European Union do not require a Polish cash register if you have the correct customs documentation. 

  • You can never use an exemption from a cash register when selling specific goods (e.g. electronics, perfumes) and when a foreign customer collects the order in person.

Do you sell products abroad and wonder how to account for it legally? Instead of wasting time guessing, you need to know one thing: the key to the answer is the place of taxation of your transaction. If you ship goods to a foreign consumer and the tax liability arises there, you will generally avoid the need to register this sale on a Polish fiscal cash register. Check what you should pay attention to in order to protect yourself from costly mistakes.

The place of taxation is your most important guidepost 

Pursuant to Art. 111(1) of the Polish VAT Act, the Polish obligation to record sales on a cash register applies to sales to natural persons and flat-rate farmers exclusively when the place of taxation is the territory of our country. If a sale qualifies as taxed in another country, it falls outside the scope of the Polish cash register obligation.

10 000 EUR limit – when do you need to stay alert? 

In the case of intra-Community distance sales of goods (WSTO), you should monitor the 10 000 EUR threshold on an ongoing basis. 

  • Sales below the limit: If you do not exceed this amount, you settle the tax in Poland. The transaction is treated as a domestic B2C sale, which may mean the need to use a fiscal cash register. An exemption is only possible here if you meet three conditions cumulatively: courier shipping, 100% bank transfer payments, and precise documentation identifying the buyer.

  • Sales above the limit: Exceeding the amount shifts the place of taxation to the destination country. In this situation, you settle with the local tax authority via the OSS system and are not subject to the Polish cash register recording requirement.

Is VAT OSS an automatic cash register exemption? 

You should not confuse a settlement tool with recording regulations. The VAT OSS system makes paying tax abroad much easier, but it is not an exemption from having a Polish cash register. The lack of a fiscalization obligation stems simply from the fact that the transaction is not subject to taxation in Poland at all.

How to safely handle exports outside the EU? 

Do you ship parcels outside the European Union? Such sales are also not subject to Polish cash register requirements, as their place of taxation lies in a third country. You only need to collect the appropriate customs documentation proving the export. Instead of a receipt, you should issue an invoice to the customer as a standard and universal proof of transaction.

When can you not avoid fiscalization? 

You need to watch out for legal traps. The regulations strictly exclude recording exemptions in several specific scenarios: 

  • In-person collection: When a customer from abroad pays online but shows up at your warehouse to pick up the goods – the sale is treated as an on-site sale and requires a cash register. 

  • Commodity groups unconditionally subject to a cash register: Regardless of the payment method, you cannot avoid a receipt when selling, among others, perfumes, radio and TV equipment, telecommunications equipment, car parts, fuels, alcohol, and (from July 2026) e-cigarettes and liquids for them.
